1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and United States Taekwondo ("we," "us," or "our"), concerning your access to and use of the https://www.us-tkd.com/ website as well as any other media form, media channel, mobile website, or extension related, linked, or otherwise connected thereto (collectively, the "Site").
By accessing the Site, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and must discontinue use immediately.
2. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us, and are protected by copyright and trademark laws. By using the Site, filling out a contact form, or booking an introductory class, you represent and warrant that:
All registration or contact information you submit is truthful, accurate, current, and complete.
You will maintain the accuracy of such information and promptly update it as necessary.
You have the legal capacity and you agree to comply with these Terms of Service.
You are not a minor in the jurisdiction in which you reside, or if you are a minor, you have received parental permission to use the Site under close guardian supervision.
4. Physical Activity & Training Liability Disclaimer
The Site provides informational text regarding martial arts styles, physical fitness, traditional weapons training, and self-defense education.
No Medical Advice: Content on this Site is for general educational purposes only and does not constitute medical advice. You should consult a physician before starting any martial arts curriculum or demanding physical exercise regimen.
Assumption of Training Risk: Martial arts instruction involves physical exertion, contact, and inherent risks of injury. By booking a free introductory class or scheduling an appointment via this Site, you acknowledge that actual participation on the training mat at our Daphne, Alabama facility is subject to a physical liability waiver that must be signed in person prior to stepping onto the floor.
5. Mobile & Text Messaging (SMS) Communications
By opting to use our text messaging features, button indicators, or forms to contact our instructional staff, you consent to receive communications, text messages, or phone alerts from United States Taekwondo at the number provided. Standard message and data rates applied by your mobile carrier may apply. You may opt out of future text correspondence at any time by replying "STOP" or contacting the school directly.
6. Limitation of Liability
In no event will United States Taekwondo or our directors, instructors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages.
7. Governing Law
These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. Any legal action or proceeding arising out of your access to the Site shall be brought exclusively in the state or federal courts located in Baldwin County, Alabama.
